Friday Terms of Service

Article 1 (Purpose)

These Terms govern the rights, obligations, and responsibilities between rimikimi ("the Company") and users of Friday (the "Service").

Article 2 (Definitions)

1. "Service" means the Friday mobile application, including running tracking, personalized voice/text comments, and route generation.
2. "User" means anyone who uses the Service under these Terms.
3. "User identifier" means the anonymous identifier issued to a user's device to provide the Service without requiring account registration. This Service does not offer an email/password account.
4. "Subscription" means the auto-renewing paid plan, purchased through the Apple App Store, that grants continued access to paid features.
5. "Free trial" means a period or usage allowance during which the Service may be used, without providing payment details, before a subscription purchase.

Article 3 (Posting and Amendment of These Terms)

1. The Company posts these Terms on the Service's initial screen and in Settings > About.
2. The Company may amend these Terms within the bounds of applicable law, announcing the effective date and reason for the amendment at least 7 days in advance (30 days for changes materially disadvantaging users).
3. A temporary change or suspension of part of the Service (Article 13) is treated separately from an amendment to these Terms or to transaction terms (e.g., pricing). The latter is always subject to advance notice.

Article 4 (Service Description)

1. GPS-based tracking and storage of running distance, time, and pace
2. Generation of personalized voice/text comments based on your past records and weather (via generative AI — Article 9)
3. Generation of loop routes starting from your current location
4. A nudge (reminder) feature that reaches out proactively after a period of inactivity
5. Management of the paid subscription and free trial

Article 5 (Eligibility)

1. The Service may only be used by persons 14 years of age or older. During onboarding, users self-declare their age; users who declare they are under 14 are not permitted to use the Service.
2. A usage agreement is formed once the user accepts these Terms and the Privacy Policy, and completes the required separate consents (health-data collection, location/location-based-service terms, and cross-border data transfer).

Article 6 (Paid Subscription and Payment)

1. Subscription pricing: Monthly ₩9,900 / Annual ₩59,000 (tax included; subject to advance notice of changes).
2. All payments are processed through the Apple App Store and charged to your Apple ID. The Company never collects or stores your payment card details.
3. Auto-renewal: Your subscription automatically renews under the same terms unless you turn off auto-renew at least 24 hours before the end of the current period. Renewal charges are billed within 24 hours prior to the end of the current period.
4. Cancellation: You may cancel anytime via iPhone Settings > [your name] > Subscriptions. Cancelling does not affect access for the remainder of the period you already paid for.
5. Required subscription disclosure (Apple standard language):

   Payment will be charged to your Apple ID account at confirmation of purchase. Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase.

Article 7 (Free Trial)

1. The Service offers a self-managed free trial that does not require payment information.
2. Trial condition: the trial ends 14 days after it begins, or after you complete 5 runs — whichever comes first.
3. No payment occurs during the trial. After the trial ends, you must actively choose a plan inside the app for billing to begin; nothing converts to a paid charge automatically.
4. Remaining trial days and remaining runs are always visible on the home screen.

Article 8 (Withdrawal and Refunds)

1. Refunds for subscriptions purchased through the App Store are handled solely by Apple, under Apple's refund policy, via reportaproblem.apple.com. The Company cannot issue refunds directly to your payment method.
2. For issues the Company can directly resolve (billing errors, duplicate charges, service outages), contact enquiry@rimikimi.com.
3. Because of the nature of digital subscription content, the right of withdrawal may be limited once service has already been provided during a billing period. The Company mitigates this by offering a 14-day (or 5-run) trial with no payment information collected before any charge occurs (Article 7).

Article 9 (Nature and Disclaimer of AI-Generated Output)

1. Nudge messages, in-run comments, and the voices reading them are all outputs of generative artificial intelligence.
2. Facts referenced by the AI (distance, pace, comparisons, weather) are drawn only from your actual records and weather data; if no supporting record exists, the sentence is not generated.
3. This app is not a medical device and may not be used to diagnose, treat, mitigate, or prevent disease. AI comments do not replace medical advice. If you feel unwell, stop exercising immediately and consult a medical professional.
4. Except where caused by the Company's willful misconduct or gross negligence, the Company is not liable for damages arising from a user mistaking AI-generated comments for medical advice.

Article 10 (Safety While Using the Service)

1. Suggested routes include reference information such as turn count and share of park/waterside paths, but the Company does not guarantee lighting, road surface, or safety conditions along any route — especially at night, where users must exercise their own judgment.
2. The Service does not provide turn-by-turn voice navigation and does not warn if you deviate from a route. Responsibility for the actual path taken and compliance with traffic laws (signals, crosswalks, etc.) rests entirely with the user.
3. Keep headphone volume low enough to hear ambient sounds such as traffic and signals.

Article 11 (Company Obligations and Limitation of Liability)

1. The Company makes reasonable efforts to provide the Service safely and continuously in compliance with applicable law.
2. Disclaiming a guarantee about lighting, road surface, or safety is a statement of fact, not a waiver of liability for the Company's willful misconduct or gross negligence. The Company does not exclude liability for damage caused by its own willful misconduct or gross negligence.
3. The Company is not liable for damages arising from causes beyond its reasonable control, including force majeure, network failures, user fault, or outages at third parties (Apple, Anthropic, ElevenLabs, etc.).

Article 12 (User Obligations and Prohibited Conduct)

Users must not: (1) impersonate another user's device identifier or repeatedly abuse the free trial; (2) interfere with normal Service operation (e.g., abnormal server access); (3) engage in conduct prohibited by law or these Terms.

Article 13 (Changes or Suspension of the Service)

1. The Company may change or suspend all or part of the Service for operational or technical reasons, announcing the reason and schedule in advance, except in urgent circumstances (e.g., security incidents) where notice may follow after the fact.
2. Such changes/suspensions are distinct from amendments to these Terms or to transaction terms (Article 3.2), the latter always requiring advance notice.

Article 14 (Termination and Restriction)

1. Users may stop using the Service anytime via Settings > Delete My Data and by cancelling their Apple subscription.
2. The Company may restrict a user's access if the user violates Article 12.

Article 15 (Personal Data Protection)

Personal data handling is governed by the separate Privacy Policy and Location-Based Service Terms.

Article 16 (Dispute Resolution, Governing Law, and Jurisdiction)

1. The Company and users will make good-faith efforts to resolve disputes amicably.
2. These Terms are governed by and construed under the laws of the Republic of Korea.
3. Disputes shall be brought before the court with jurisdiction under Korea's Civil Procedure Act.

Business Information
